Town Plan Commission Meeting Minutes

Wednesday, February 7th, 2018, 5:30 p.m.

Roll call was taken: Present, Kathy Girolamo, Betty Pionek, Sandy Meis
Absent: Doug Evica

1) Meeting was called to order and Kathy led the Pledge of Allegiance

2) Public notice was given

3) Minutes from the meeting of January 30, 2018 were approved with amendment of adding last names for Kristen and Chris and that they are from Portage County Planning and Zoning.

4) Continuation of Review/Discussion of plans and information provided for the Pourchot parcel #’s 014-25-0701-13.02 (4532 County Road X), 014-25-0701-04.04 (4646 County Road X), and 014-25-0701-03.03 that are owned by Regan and Ann Pourchot. These properties are dissected by the Little Eau Claire River and are zoned A4 and Conservancy. New data provided by Portage County Planning and Zoning Department (2009 floodplain and 2016 wetland) shows that portions of these parcels could be removed from the Conservancy district, which would include the barn that is currently in the Conservancy zone at 4532 County Road X.

The Pourchots’ propose to operate an agricultural event center, tourist rooming house and campground on parcel #014-25-0701-13.02 with signage that exceeds six square feet.

a. Discussion/Possible Action on recommendations to the Town of Dewey Board on the request of Regan and Ann Pourchot for the special exceptions in the A4 zoning district as follows:

The Planning Commission received three letters from concerned residents (Peter and Gretchen Hintz, Irv and Betty Wachowiak and Todd and Amy Fairchild) opposing the request of Regan and Ann Pourchot. These letters will be submitted to the Town Board with these meeting minutes.

i. The use of the old farm house for short term rentals as a tourist rooming house on parcel # 014-25-0701-13.02;

1. The following motion was made by Kathy Girolamo and Seconded by Betty Pionek – Motion carried 3-0
a. Motion to recommend approval of the special exception request in the A4 zoning for the use of the old farm house residence for short term rentals as a tourist rooming house on parcel # 014-25-0701-13.02 as submitted with consideration to our current Town of Dewey Comprehensive Plan. If the Dewey Town Board and/or the Portage County Board of Adjustment find merit in this request and approves it, we recommend attaching the following conditions that are drafted in the Pourchot's 1-30-18 letter (provided and attached) along with the following conditions:
i. Obtain necessary permits (Town/Zoning; Health Dept., etc.)
ii. All applicable tax must be paid (Room, etc.)
iii. Adequate Sanitary System
iv. Property line must be identified or designated to the tenant and clearly marked with signage at all property lines
v. Occupancy limits must follow the Portage County Health and Human Services regulations.
vi. All state of Wisconsin fire requirements must be met per WI codes
vii. Proof of Certificate of insurance (rental/commercial, liability, etc.)
viii. Contact number(s) must be available for current local Emergency Services and current owner/agent and owner/agent must be available 24 hours a day
ix. Boating and fishing regulation are included in rental information (for river property)
x. No RV’s, pop-up campers, tents or other means of overnight stays to exceed maximum occupancy of the rental dwelling allowed.
xi. All vehicle and utility trailer parking must be contained on the property (not allowed to park on the road)
xii. All camp fires must be attended
xiii. Quiet hours from 10:00 pm to 8 am
xiv. Pets must be restricted to the property and nuisance dog barking is prohibited
xv. Property must remain free from all illegal activity
xvi. Trespass laws must be abided by at all times
xvii. Discharging of Firearms and fireworks is strictly prohibited; this includes Chinese Lanterns and all other incendiary devices.
xviii. No ATV’s, 3 or 4 wheelers, scooters or go-karts
xix. These criteria may be amended from time to time as deemed necessary for public health and safety

ii. The operation of an agricultural event center at the existing barn on parcel # 014-25-0701-13.02;

1. The following motion was made by Kathy Girolamo and Seconded by Sandy Meis – Motion carried 3-0
a. Motion to recommend denial of the special exception request in the A4 zoning for the operation of an agricultural even center on parcel #014-25- 0701-13.02 with consideration to our current Town of Dewey Comprehensive Plan. If the Dewey Town Board or the Portage County Board of Adjustment find merit in this request and approves it, we recommend attaching the following conditions to ensure that the more intense use is minimalized:
i. To limit the capacity to no more than 300 people for any event.
ii. To provide permanent sufficient restroom facilities that meet the capacity of people that has adequate septic system capacity and protection of the ground and surface water.
iii. Every year the Town Board has the right to review the Pourchot property special exception to ensure all conditions are being met. If conditions are not being met the board will work with Portage County Planning and Zoning to have conditions met or have the operations shut down.
iv. The property owner will allow unannounced inspections by Town Board Officials, Town Fire Department and Portage County Planning and Zoning.
v. Insulate the barn to mitigate noise level.
vi. A gravel driveway will be constructed from the Event Barn to Hwy DB built wide and strong enough to handle emergency vehicles such as a Fire Truck.
vii. No parking allowed on County Hwy X or County Hwy DB. Adequate parking must be provided on-site. The parking must be big enough to accommodate the wedding guests, workers, caterers, bartenders, etc.). Adequate parking for the 300 capacity limit with protection of the land zoned Conservancy from storm water run-off.
viii. Owners must secure adequate liability insurance
ix. The facility must be handicapped accessible
x. The facility must have at least two lighted Exit signs and have backup generator in case of an electric outage for the safety of occupants.
xi. Hours of operation: May through October Friday hours 3 pm – 11 pm, Saturday hour’s noon – 11 pm and Sunday hours 9 am – 1 pm. If weekday evenings are requested, activities would end by 10 pm.
xii. Smoking is prohibited in the building and within 50 feet of the building.
xiii. No smoking and fire extinguisher signs should be posted and fire extinguishers readily available
xiv. The building will be equipped with smoke detectors.
xv. All existing trees on the property should remain as a buffer to help with noise for surrounding neighbors. Additional trees should be planted on the west side of the property to help mitigate noise.
xvi. The event barn should be inspected for safety and reviewed annually.
xvii. Discharging of Firearms and fireworks is strictly prohibited; this includes Chinese Lanterns and all other incendiary devices.
xviii. All electrical wiring installed in the building satisfies requirements of the state electrical wiring code.
xix. The building has the means of egress and escape in case of fire that applies to places of employment of similar capacity and function.
xx. All music to be played in the event barn no outside speakers.
xxi. Private party events only, no concerts, etc.

iii. Development of campground sites on parcel # 014-25-0701-13.02;

1. The following motion was made by Betty Pionek and Seconded by Sandy Meis – Motion carried 3-0
a. Motion to recommend denial of the special exception request in the A4 zoning for the development of campground sites on parcel #014-25- 0701-13.02 with consideration to our current Town of Dewey Comprehensive Plan for this recommendation. If the Dewey Town Board or the Portage County Board of Adjustment find merit in this request and approves it, we recommend attaching the following conditions to ensure that the more intense use is minimalized:
i. Number of sites limited to 29.
ii. Satisfy HHS regulations.
iii. Quiet hours enforced from 11 pm to 8 am.
iv. Protection from waste water discharge and run off to the ground and surface water.
v. Camping will only be allowed if the event center is being used, not open to the general public.
vi. Discharging of Firearms and fireworks is strictly prohibited; this includes Chinese Lanterns and all other incendiary devices.
vii. Road built through campground heavy enough to hold heavy vehicles such as emergency vehicles and motor homes.
viii. There must be a designated fire area.
ix. No pets during events.
x. No generators in the campground.
xi. Number of people per site limited to 6 and no more than 1 Camper or 2 tents per site.
xii. No ATV’s, 3 or 4 wheelers, scooters or go-karts
xiii. All visitors must leave campground by 11 pm
xiv. All firewood will be provided by the campground owner and no firewood can be brought in to the campground.

iv. Signage that would be used to advertise the usage at either address off County Road X that would exceed six square feet.

1. The following motion was made by Betty Pionek and Seconded by Sandy Meis - Motion carried 3-0
a. Motion to recommend approval of the special exception request in the A4 zoning for signage that would be used to advertise the usage on parcel #014-25-0701-13.02 off County Road X with consideration to our current Town of Dewey Comprehensive Plan, with the following conditions:
i. Signage lighting would not negatively impact traffic and neighbors.
ii. Signage not to exceed 20 square feet in size.

5) Correspondences
a. Kathy Girolamo distributed some information regarding training sessions for Planning Commission Members

6) Next meeting schedule – TBD based on Kristen Johnson’s schedule and after the 2/21/2018 Town Board Meeting where an additional Planning Commission member may be approved.

7) Meeting adjourned 8:30 pm
